What Realtors do in Georgia


         In Georgia, Realtors and agents can represent buyers, or sellers, or both, even in the same transaction. Georgia law and standard practices in the industry allow Realtors to represent buyers or sellers as clients or as customers. This gives buyers and sellers the opportunity to pick who they want to work with, and to obtain the best possible representation in their real estate transaction.

        Buyers typically take the opportunity to choose an agent to represent them, and this is especially worthwhile if they are from out of town, or are unfamiliar with a particular neighborhood or area, or want to take advantage of their agents' vast expertise on general or specific real estate situations, such as foreclosures for example. Tony and Marti have represented many buyers who have chosen homes all over the North Atlanta Metor area, from Douglasville to Gainesville, and from inside the perimeter to Dahlonega and beyond. Having a broad market area allows us to provide valuable insight to our clients and permits them to make wise choices on the location of their new home.

        Need an Attorney to purchase or sell a home? If you think you do, go ahead and hire one. They'll charge you by the minute for each and every word they provide. Most property purchases and sales are completed without the need of an attorney. In Georgia, real estate agents fill out pre-printed forms approved by, and annually modified by, the Georgia Real Estate Commission, and we attend annual training on the use of these forms. Good agents, like ourselves, are well versed in how the forms are used, the ins and outs of the protections that are built into the forms, and which Special Stipulations, Exhibits and Addendums are needed to protect their clients. Additionally, our corporate attorney is available to answer questions for our clients, brokers and agents. So when you want to buy or sell a property, most of the time a separate attorney is not needed in this well-regulated industry. The GREC has done a great job in writing and keeping updated the forms we use. In fact, it is our standard practise to refuse an offer from an agent who has used an outdated form (like last year's version), and request that they use the current forms. Our closings are conducted by real estate attorneys, who will normally represent the lender if a mortgage is involved. You can always hire an attorney to represent you. A word of caution here: If you hire an attorney to write, review or rewrite a purchase offer and modify, or not use, the standard GAR forms, most agents will not accept the offer and will advise their clients to do the same. Real estate agents are not lawyers, and once a non-standard written offer is introduced, it is beyond our legal abilities to advise our clients on the offer's provisions.
